General Counsel

About This Role

This General Counsel role serves the South Carolina Recovering Professional Program (SCRPP), providing legal counsel to staff on applicable law and administrative procedure. The position involves planning overall legal and administrative activities and handling complex issues, including substantive legal analysis. The SCRPP is a confidential referral and monitoring program for impaired health professionals in South Carolina.

Responsibilities

• Review and analyze draft letters and correspondence to ensure they provide a full and complete picture of the file, fair to the participant
• Revise and return correspondence to assigned team members
• Review and analyze charts of inconsistencies and/or information to be added to correspondence
• Confirm that each letter/position aligns with SCRPP policy and applicable law
• Assess files for possible legal concerns, including participant-provided documents, assessment and treatment documents, internal notes, test results, and testing-related concerns, from an adverse perspective
• Draft higher-level substantive analysis when requested or deemed necessary
• Handle requests for SCRPP compliance letters, including individual requests by participants or third parties, and requests for ongoing compliance updates from major hospital systems
• Receive and respond to calls from attorneys, intercepting communication directed to other SCRPP staff
• Arrange facts and address issues to minimize potential liability
• Receive and respond to calls/communication from SCDLLR
• Review and respond to requests for participant files/document production
• Prepare for, attend, participate in, and/or respond to legal issues for RCRC, Advisory Committee, QA, IRC, and SCRPP discharge meetings
• Draft and disseminate IRC decisions
• Attend SCDLLR board meetings, including assessment and minimization of any file-related deficiencies and/or concerns in advance of each meeting
• Represent SCRPP before various boards related to SCRPP policy and board preferences
• Research and stay knowledgeable concerning state and federal administrative and confidentiality law
• Communicate internally and externally as appropriate
• Identify and implement internal changes to bring SCRPP into compliance
• Participate in file auditing to identify internal deficits as part of continuous improvement and risk mitigation
• Provide input concerning personnel-related issues and SCRPP policies
• Participate in planning overall legal/administrative activities, including interviewing and talent selection
• Lead and/or participate in the RFP process
• Attend staffing and provide legal input when appropriate based on the information provided
