Administrative Law Judge/Assistant Administrative Law Judge (NY HELPS)

About This Role

This role involves professional legal work as an Administrative Law Judge, also known as a Motor Vehicle Referee, conducting administrative hearings and making decisions. The position suits a motivated individual interested in public service as part of an active legal team, with a focus on traffic violations and regulatory compliance.

Responsibilities

• Conduct administrative hearings and render decisions for adjudication of moving traffic violations
• Adjudicate cases involving fatal accidents, persistent violators, false statements on Motor Vehicle documents, or driving without insurance
• Conduct hearings involving charges of violations of the Vehicle and Traffic Law and the Commissioner’s Rules and Regulations by commercial establishments such as repair shops, dealers, inspection stations, driving schools, commercial bus drivers and school bus operators
• Prepare cases for review by the Motor Vehicle’s Appeals Board in some instances
• Render decisions for violations of the Navigation Law by boaters
• Render decisions for violations of the Parks, Recreation and Historic Preservation Laws by operators of snowmobiles
• Consider the Zero Tolerance Program and new regulations concerning emission inspections in decisions

Requirements

• Admission to the NYS bar and two years of post-licensure professional legal experience (for Administrative Law Judge)
• 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience in the trial of issues in courts of record or in the conduct or trial of adversary proceedings, quasi-judicial in nature, before a governmental department or agency (for Assistant Administrative Law Judge)
• One year of permanent, contingent-permanent, or 55 B/C service allocated to a Grade 21 or higher eligible for transfer and deemed administrative under Section 52.6 of the Civil Service Law; OR in a title approved for transfer under Section 70.1 of Civil Service Law. The transfer cannot be a second consecutive transfer resulting in an advancement of more than two salary grades (for transfer eligibility)
• Eligibility for 55b/c designation and a current 55b/c eligibility letter (for 55b/c appointment)
• Satisfy at least one of the Open Competitive qualifications listed (for 55b/c appointment)
